I understand that Hep C is transmitted by body fluid (blood, semen, secretion...), but that doesn't necessarily PROVE that your dad contracted it during that particular operation. I am -hoaks(瞎起哄别当真); 2006-2-2 {425} (#2759302@0)
by no means siding with the hospital. However, in the court, the hospital may argue that there are lots of other ways your dad might have got the hep C: unsafe sex, using drugs (cocaine, etc), kissing, injury, other hospital visits, so and so. You can try to find out if there are other Hep C pateints which underwent same surgery in the same facility and around the same time period. Even that is only a link, not a proof.
